THE INTRODUCTION

These Terms and Conditions regulate the use of the website www.fiappo.com and any commercial transaction carried out through the online store between the Final Consumer (hereinafter referred to as "User") and Armando Flávio Alves Leite, Lda. (hereinafter referred to as "Fiappo").

Fiappo will be the entity responsible for the sale on the website www.fiappo.com of the articles manufactured by it and of the various brands of its suppliers, and all e-commerce services are only available to end consumers, for resale purposes.

Browsing the website www.fiappo.com and purchasing any product disclosed therein implies acceptance of these Terms and Conditions.

When using the website www.fiappo.com and placing an order there, the User:

• You declare that you have read and agreed to these Terms and Conditions, without the need for any further act or consent;

• You declare that you are at least eighteen (18) years of age and/or of legal age in the jurisdiction of your residence;

• Declares that it has the legal possibility to contract and use its own means of payment;

• Declares that it will not make fraudulent use of the website, contrary to the law or good customs;

• Declares that he accepts that Portuguese legislation will govern any conflict with the consumer, without prejudice to legal provisions to the contrary, community directive or international treaty.

All contractual information is written in Portuguese, as well as article information, email communications and formalization of the sale.

Fiappo does not guarantee that all information published complies with the legislation in force in the User's jurisdiction, with the exception of the territory of Portugal and, when applicable, the European Union. Therefore, access to content published on the website from places where it is illegal is expressly prohibited. The User who chooses to access this website from these locations will do so at his/her own risk, and will be solely responsible for such act.

The User and Fiappo agree that any legal issue related to the use of the website www.fiappo.com will be settled exclusively in the District Court of Santa Maria da Feira, Portugal, without prejudice to mandatory provisions to the contrary in the legislation. Portuguese law, Community directive or international treaty.

B.1. - PRIVACY

The website wwwfiappo.pt is protected in accordance with international internet standards, so, if used correctly, the User is guaranteed safe browsing.

Fiappo declines all responsibility for any problems, delays in the delivery of electronic communications, damages, transmission of viruses or risks that the User may incur during the misuse of the website, as well as any deficient use of the same and/or or intersections or manipulations of electronic communications by third parties and/or virus transmissions.

B.4. - DESCRIPTION OF ARTICLES AND PRICE INFORMATION

Fiappo assumes no liability arising from the improper or inappropriate use of the products sold on the website www.fiappo.com. The User is requested to carefully analyze the information about the product he intends to buy.

All articles presented on the website www.fiappo.com are described as accurately as possible. The photographs shown are merely illustrative, so it is recommended that you consult the product detail for better information about the respective characteristics of the items you intend to purchase.

The User should read the description of the articles as carefully as possible and, if he has any questions, he should contact Fiappo via e-mail geral@armandoflavio.com or by telephone (+351) 227.442.489.

Due to the type of computer used, color settings, internet browser or others, the colors shown in the photographs on the website www.fiappo.com may differ from the actual colors. Fiappo cannot be held responsible for such differences.

Fiappo publishes information on its website www.fiappo.com in order to provide the best service to the User and updates this information frequently. Information about the products marketed by Fiappo is displayed on the website www.fiappo.com, as provided by the manufacturer or authorized distributor, and is not reviewed by Fiappo. Fiappo declines any responsibility for any omissions or errors in this information, as well as for technical inaccuracies and/or typographical errors that may arise, namely due to incorrect insertion of the price of an article. If Fiappo finds that there was an inaccuracy and/or typographical error in inserting the price of the article on the website www.fiappo.com, it will inform the User of this after receiving the order, allowing the User to ) cancel or modify your order, as explained in point D.2. of this document.

B.5. - UNAVAILABILITY OF STOCK

Fiappo reserves the right to inform the User, during the 72 (seventy-two) hours after receiving the order, of the unavailability of any item ordered. After informing the User of this unavailability, the contract is considered automatically resolved regarding the unavailable item, and the User is guaranteed that he/she will not incur any costs due to the cancellation of the order regarding the unavailable item. , the amount shown in the User's account statement being cancelled, in due proportion. The contract will be maintained and will produce its normal effects with regard to other items eventually ordered, unless otherwise stated by the User.

B.6. - FREE RESOLUTION OF THE CONTRACT

If, for any reason, the User is not satisfied with the order, he/she may terminate the contract within 14 days from receipt of the order, with the User being reimbursed for all amounts paid in the meantime. (cost of products and cost of delivery of the order).

The costs of returning the order, in the case of free termination of the contract within the indicated period, are borne by the User.

When returning products, the User must comply with the conditions and procedures set out in Section F.

Fiappo does not recognize the right to free termination of the contract in the following situations:

a) Supply of goods made in accordance with consumer specifications or clearly personalized;

b) Supply of goods that, after delivery and due to incorrect use, are damaged.

This type of items can only be returned if they are defective or non-conform to the characteristics ordered, in accordance with current legislation.

B.7. - WARRANTY

If the purchased product is defective, the User must report the situation to Fiappo, informing the order number and the description of the malfunction. The costs of returning or collecting products under these conditions will be borne by Fiappo.

Upon receipt of the product at Fiappes' facilities, verification will be carried out and, in the event of any lack of conformity, the article will be replaced.

In this case, Fiappo will replace the product and send it again to the User's address at no additional cost.

The User may also choose to return the product or terminate the contract, being refunded the amount referring to the defective or non-conforming product and the respective shipping costs. If the User has purchased more than one product in the same order, the share of the shipping cost for that product will be refunded.

B.8. - TRANSFER OF RISK AND OWNERSHIP OF PRODUCTS

Fiappo retains ownership of the products until it has received payment in full for all such products.

The risks of the products will be borne by the User from the moment the order is received at the address indicated by the User.

B.9. - CHANGE OF TERMS AND CONDITIONS

Fiappo reserves the right to modify the terms and conditions contained in this legal information. The User will receive notification of the change in terms and conditions when opening the website www.fiappo.com or when accessing its reserved area.

C. PRICES AND PAYMENTS

C.1. - PRICES

All prices on the website www.fiappo.com are shown in EUR/€.

The price shown for each product on the website www.fiappo.com does not include its transport costs, but includes the Value Added Tax (VAT) rate in force in Portugal at the time of purchase, applied to all intra-community purchases.

For the non-EU User, the VAT amount will be removed at the time of the checkout process.

At the end of the order, the total price specified includes VAT (when applicable) and shipping costs, calculated for each order depending on the place of delivery and the weight of the order.

The shipping costs associated with your order will be invoiced per order, that is, if you order more than one item, you will only pay the shipping costs once. However, Fiappo reserves the right to split the delivery of the order, for example, if the items ordered are in a number that cannot be shipped in a single package, or if a part of the order is delayed or unavailable. In the event that Fiappo considers the division of the order, the User will be notified at the time of order confirmation and/or through the e-mail indicated by him/her at the time of ordering.

C.2. - PRICE CHANGES

Fiappo reserves the right to change prices of products on sale without prior notice. Despite Fiappo's extreme attention to keeping all information up to date, some products may contain an incorrect price, so we will check prices whenever we process orders. If the price of the product is lower than the advertised price, the difference will be refunded to the User. If the price is higher, the User will be informed by email, and the order will be subject to a new acceptance.

C.3. - PAYMENT OPTIONS

Fiappo urges the User not to make the payment by any other means not specified on the website www.fiappo.com. If you try to do so, Fiappo cannot be held responsible for the loss of payment, or any other damages that may arise therefrom.

On the website www.fiappo.com you can make the payment through the following means:

a) Bank Transfer

b) ATM Reference

C.4. - BANK TRANSFER

When finalizing an order, the User will be informed of the data for the bank transfer to the account held in the name of Fiappo. The transfer of the amount must be carried out within a maximum period of 3 (three) days.

After carrying out the transfer, the User must send Fiappo proof of the transfer with information on the order number he/she received in his/her email box.

Fiappo will only ship the order after payment has been made. Orders that are not paid within the aforementioned period are considered automatically resolved, at no cost to the User.

C.5. - PAYMENTS THROUGH MULTIBANCO

The User with a bank account domiciled in a Portuguese bank can settle their orders on the website www.fiappo.com using the Multibanco payment system.

Upon completing the order, the User will immediately receive an email with the Multibanco reference to proceed with the payment, within a maximum period of 48 hours.

Fiappo will only ship the order after payment has been made. Orders that are not paid within this period are considered automatically resolved, at no cost to the User.

D. ORDERS

D.1. - ORDER PROCESSING

To place an order on www.fiappo.com, the User must have a valid and frequently used e-mail account. If you are a registered User, simply log in by entering your registration credentials.

The User's registration at www.fiappo.com is optional (but recommended) in order to make a purchase. Registration is quite quick and simple. An online form will be displayed for you to complete. Registration is useful, as you can access your purchase history, monitor the status of your order and make it easier for you to make your next purchases.

To place an order on www.fiappo.com is very easy:

o Browse www.fiappo.com and find the products you want to purchase;

o Add your favorite products to the shopping cart using the "add" button;

o When you understand that you have already chosen all the parts you want to purchase, complete the purchase by going to your shopping cart and clicking on "checkout" or "payment";

o You will see the list of products you have chosen. Click on the "make payment" button to continue the purchase process;

o Then, fill in your personal data in a form (be careful when filling in the address, as well as all the fields marked with a red asterisk, as they are mandatory fields);

o If you want to send your order to a different address than the billing address, then you must select the box (blinking) "send to a different address" and fill in the requested data;

o Review your order, select the payment method and select the sign that you agree with the terms and conditions;

o Before confirming the order, you will be able to view the estimated shipping costs of the items;

o If the order is as intended, confirm the order;

o Finally, you will receive an order confirmation via email;

o After making the payment for the entire order, you will only have to wait for the days foreseen for the postal delivery of the products or for collection at the company.

As soon as the purchase is completed, the User will receive an automatic email confirming the transaction. We suggest that you save it for future reference.

In the event that the data is not correct, the User may ask to change them until the order is shipped, which takes place up to a period of 3 (three) days. If the order has already been shipped, there will be no way to cancel the purchase. As a last resort, you should contact Fiappo directly by e-mail to geral@armandoflavio.com or by telephone (+351) 227.442.489.

In order for Fiappo to provide the best service, the User undertakes to correctly provide his/her email, address and/or other contact information and to be aware that we may use this information to contact you. , if it's necessary.

D.2. - CANCELLATION OF THE ORDER BY THE USER

Orders for made-to-order and made-to-measure products cannot be cancelled, as the production process begins immediately after receiving the order. The order for this type of article can only be canceled if Fiappo has not yet started its production process.

If the User places an order and wishes to cancel it, he/she must contact Fiappo, via the email geral@armandoflavio.com or the telephone contact (+351) 227.442.489, and request the cancellation of his/her order so that it is not shipped. If the order has not yet been shipped, it will be canceled and Fiappo will seek to refund the User within 5 (five) days.

If the cancellation request is successful, the User will be notified by email of this decision and the cancellation will be processed at no cost to the User.

If the cancellation request is not possible because the order has already been shipped, the products will be sent to the User who, if he/she maintains his/her intention to cancel the order, must refuse to receive them, processing the reimbursement pursuant to point F.3. of these Terms and Conditions. However, in this case, the User must bear the costs of returning the products.

If the order has already been shipped and the items ordered are items whose characteristics compromise their quality, returns will not be accepted.

D.3. - REASONS FOR REFUSAL TO PROCESS AN ORDER

In case of non-confirmation of payment within 5 (five) days after confirmation of the order or failure to comply with these Terms and Conditions, Fiappo reserves the right not to accept your order, or to cancel it, in full. or partially, even after the automatic confirmation of the same.

Fiappo also reserves the right to refuse any order, regardless of the reason and is exempt from liability for any damages or costs, as well as reserves the right to cancel any purchase, even if it has already been accepted or confirmed by Fiappo, namely in the following situations:

o The information on the invoice is not correct or verifiable;

o The order is flagged by the website's security systems as an incorrect, irregular order, or an order susceptible to fraud;

o When the transfer of payment for the order has not been received within a period of 5 (five) working days following the acceptance of your order;

o When it is not possible to deliver the order to the address provided by the User;

o If you consider that the User did not have the capacity to perform that act;

o If it is found that there was an error in the presentation of the price of the product(s);

E. SHIPMENTS AND DELIVERY

E.1. - EXPEDITIONS

The products ordered in the online store www.fiappo.com will be shipped and delivered on working days, from Monday to Friday via CTT EXPRESSO or by courier.

The costs of shipping the items ordered will be added to the value of the order in the process of completing it, the User being expressly informed of this amount before confirming his order.

Transport costs do not include any import fees that may be charged upon entry into the User's country of destination.

Delivery times may be slightly longer during sales, festivities and holidays. With the exception of these exceptions, the normal foreseeable delivery times will be:

E.2. - IMPORTANT INFORMATION

Fiappo only dispatches orders on working days. Thus, to estimate the delivery time of orders, weekends and holidays are not taken into account.

The delivery times indicated above are merely indicative, and do not take into account any delays caused by problems with payment authorizations or with customs clearance in the country of destination.

Any delay in the dispatch of items, in view of the estimated dates presented, does not entitle the User to compensation.

Orders sent by CTT Expresso or courier require a signature upon delivery.

Fiappo will not be able to change the delivery address of orders from the moment they are dispatched.

If the User does not claim his order with the carrier, within the time allowed and the order is returned to Fiappo, the transport costs of a new shipment of the order will be borne by the User. (The).

If the User wishes to receive the order before a certain period or on a certain date, he/she must inform Fiappo before the conclusion of the contract. In these situations, Fiappo will agree with the User the best way to ship the order.

E.3. - CUSTOMS DUTIES AND CHARGES

For all shipments to European Union countries, prices include VAT at the legal rate in force. In orders for non-EU countries, the VAT amount will be removed at the time of completion of the order.

Extra-Community orders may be subject to VAT, Import Duties and/or Taxes to be charged once the order arrives in the recipient's country. Fiappo's shipments are made in accordance with the Incoterm Delivered Duty Unpaid (DDU) which means that Fiappo does not charge VAT, Customs Duties and/or Taxes for non-EU countries, and cannot predict what those costs might be. If orders are subject to any additional charges, these will be charged directly by customs in the country of destination. The User should contact his/her local customs services for further information.

E.4. - DELIVERY STATUS

In principle, all orders are shipped from Fiappo's warehouse within 3 days of payment confirmation.

As soon as the order is shipped, Fiappo will send an email to the User with instructions for tracking the shipment and collecting it.

For all orders, the shipment confirmation will include the indication of the carrier as well as the information of the shipping tracking number.

The User may track his/her order on the CTT website using the tracking number provided at the time of shipment confirmation.

Since CTT Expresso requires a signature at the time of delivery of orders, the User, or a representative, must be present at the address of destination at the time of delivery.

Fiappo considers orders as "delivered" when the User, or a representative, signs the receipt of the same at the delivery address indicated by him.

E.5. - EXPEDITIONS AND COLLECTIONS

During the registration process on the website www.fiappo.com, the User will have to provide his/her personal address.

Orders will be delivered to the address defined as the User's address. If the User wants the order to be sent to an alternative address, this address must be indicated at the time of completion of the order.

If the User wishes to ship items to more than one address, he/she must place an order for each of these addresses. In this case, the User will be charged a shipping cost for each order placed.

With the tracking number provided for each order, the User will be able to track it at any time.

Due to restrictions imposed by carriers and the risk of credit card fraud, orders placed on www.fiappo.com are not delivered to PO Boxes.

E.6. - SUCCESSFUL DELIVERY OF EXPEDITIONS

We can only guarantee that every order that leaves the company is in the best condition and without any damage. We are not responsible for the poor condition of the order at the time of delivery. We also emphasize the fact that the good delivery of an order is achieved if the shipping address of the products is correctly indicated by the User, or if the responsible carrier takes the greatest care in transporting the same.

We urge the User, upon delivery of all shipments, to carefully inspect the box before signing the delivery document.

If, for any reason, the packaging appears to be tampered with and/or damaged, please sign the delivery document with reservations, or refuse delivery.

If you accept delivery of the order with reservations, or if you refuse it, please immediately file a claim with the carrier and contact Fiappo via email geral@armandoflavio.com or telephone (+351) 227.442.489.

E.7. - NON-DELIVERED ORDERS ATTABLE TO THE USER

If the order is not successfully delivered to the User's address, due to any reason attributable to the User (absence of a person at the address, wrong telephone contact, wrong or incomplete address, non-compliance with import regulations, etc.) , according to the commercial agreement with Fiappo, there may be a risk that the order will be returned at the User's expense, including any import fees that may be charged upon re-entry into Portugal, in the case of shipments to countries extra-community. These costs will be deducted from any eventual reimbursement.

E.8. - NON-DELIVERED ORDERS ATTABLE TO FIAPPO

If for any reason attributable to Fiappo it is not possible to deliver the ordered items, within 30 (thirty) days after order confirmation, a new delivery date will be proposed to the User. If this new date is not convenient for any reason, the User may terminate the contract, without any expense or charge. The User will be reimbursed for all amounts paid in the meantime, within a maximum period of 30 (thirty) days from the termination of the contract.

E.9. - RISK

Fiappo guarantees each purchase during the transit period, until the moment of delivery to the User. All orders require a signature upon delivery, at which time the responsibility passes to the User.

If the User designates a recipient other than himself/herself, for the purposes of delivery, then he/she accepts evidence of a signature as proof of delivery and compliance by Fiappo and the corresponding transfer of responsibility Similarly.

E.10. - FORCE MAJEURE

In case of force majeure, Fiappo's obligations may be delayed. The contract between Fiappo and the User may, in such cases, be partially or completely terminated by either party.

Force majeure is considered whenever situations of war, civil war, revolution, riot, governmental measures, strikes, blockades, pandemics or natural disasters arise.

In any of these cases, Fiappo will do everything to resolve the problem with the User as soon as possible.

The User will always have the possibility to terminate the contract if the order is not delivered within 30 (thirty) days after confirmation of the order, being refunded of all amounts paid in the meantime.

F. FREE TERMINATION OF CONTRACT AND REFUNDS

F.1. - FREE RESOLUTION

If, for any reason, the User is not satisfied with the order, he/she may terminate the contract within 14 (fourteen) days from the day following receipt of the order, the User being ) reimbursed of all amounts paid in the meantime, with the exception of transport costs.

The exercise of the right of free resolution does not affect the User's right to inspect, with due care, the nature, characteristics and operation of the product. The User can be held responsible for the depreciation of the product, if the manipulation carried out to inspect the nature, characteristics and functioning of that product exceeds the manipulation that is usually allowed in a commercial establishment.

Fiappo does not recognize the right to free termination of the contract in the following situations:

a) Supply of goods made according to the consumer's specifications or clearly personalized;

b) Supply of goods that, after delivery and due to incorrect use, are damaged.

This type of items can only be returned if they are defective or non-conform to the characteristics ordered, in accordance with current legislation.

Return costs are borne by the User. There is no refund of any customs duties, taxes or additional charges that the User may have borne, which will not be reimbursed by Fiappo.

In order to exercise the right to terminate the contract, the User may, by any means, communicate this intention to Fiappo, namely:

a) By telephone to the number (+351) 227,442,489, expressing this intention and indicating the order number.

b) Via email to geral@armandoflavio.com, communicating your intention to terminate the contract, indicating, for this purpose, the order number that was provided to you with the order confirmation. If you do not want to terminate the contract for all items in the order, you must also specify the references of the items covered by the termination of the contract.

F.2. - PRODUCT RETURN INSTRUCTIONS

After receiving the request for free termination of the contract, Fiappo will confirm the resolution to the User and send an email with the return coordinates, making it possible to return the item.

Items to be exchanged or returned must be in good condition, complete and properly packed in the original packaging, if any. The User is only responsible for the depreciation of the goods resulting from a handling that exceeds what is necessary to verify the nature, characteristics and functioning of that good.

The User must return the article within a maximum period of 14 (fourteen) days, counted from the receipt of this e-mail, otherwise Fiappo will not accept the termination of the contract.

If the goods are not received by Fiappo within this period of 14 (fourteen) days, the User will be contacted by email in order to demonstrate documentary evidence that he/she returned the goods within the indicated period. If the User does not demonstrate in documents that he has returned the goods, Fiappo reserves the right not to accept the termination of the contract.

At the time of making the return, the User must clearly identify the order, before the customs authorities and all transport forms as "RETURNED GOODS", and must also write this expression on the outside of the box, in a clearly visible place.

All items will be checked upon arrival at our service and only those that comply with the return conditions will be accepted for exchange or return.

F.3. - REFUNDS

Refunds will be processed within a maximum period of 14 (fourteen) days from the date on which Fiappo was informed of the decision to terminate the contract.

The User must inform Fiappo by email of the IBAN of his/her bank account, so that it can transfer the amount to be refunded.

F.4. - DAMAGE CAUSED IN TRANSPORT / DEFECTIVE ITEMS

The return of defective items will only be accepted if the items are already defective at the time of delivery to the User. The Fiappo team makes a great effort to carefully check all items to detect any defects in the items, before proceeding with their shipment.

Fiappo reserves the right to request photographic support for defective items or wrongly shipped merchandise, before authorizing the return, for the purpose of reimbursement of transport costs.

All items returned as defective will be properly inspected upon receipt and all items subject to normal wear and tear will not be considered defective.

The User may choose to send a replacement item or to refund the amounts paid.

Refunds for defective items will be made within 30 (thirty) days after receipt of the returned items.

If Fiappo is unable to replace the defective item, it will refund the amount paid through the payment method originally used.

G. EXCHANGES

If, for any reason, the User is not satisfied with the order, he/she may exchange the goods, within 14 (fourteen) days from receipt of the order, with the exception of products manufactured to order and/or made-to-measure (unless there are defects or non-conformities in relation to the characteristics ordered).

To exchange goods, the User may, by any means, communicate this intention to Fiappo, namely:

d) By telephone to the number (+351) 227,442,489, expressing this intention and indicating the order number.

e) Via email to geral@armandoflavio.com, communicating your intention to exchange the goods, indicating, for this purpose, the order number that was provided to you with the order confirmation.

As soon as the items to be exchanged are received and checked, the new item will be shipped immediately.

As with the exercise of the right of withdrawal, all Customs Duties, taxes or additional costs that the User may incur will not be reimbursed by Fiappo in the event of an exchange of items.

The transport costs for the exchange of the product are the sole responsibility of the User.

Fiappo does not guarantee the availability of stock for the purpose of exchanging products.

Products sold defective, and duly identified accordingly, are not exchangeable.

H. RESPONSIBILITY

In the event that the User finds, on other websites, hyperlinks ("links") that allow him/her to access the website www.fiappo.com or references to Fiappo's online store, we inform you that Fiappo does not have any responsibility for these links or websites, nor for the contents contained therein.

Fiappo will only be liable for damages suffered by the User in the event that such damages result from breaches attributable to Fiappo's contractual obligations towards the User, or in case the liability results from applicable legislation.

If the User has suffered damages related to the activity of the website www.fiappo.com, Fiappo's liability will be limited to: damage to Fiappo products, reasonable and verifiable costs incurred by the User in due to the breach by Fiappo of these Terms and Conditions.

I. FINAL PROVISIONS

I.1. - PARTIAL CANCELLATION

If any of these terms and conditions or any provision of a contract is declared null and void, by firm resolution by a competent authority, the remaining terms and conditions remain in force, unaffected by that declaration of nullity.

I.2. - SINGLE AGREEMENT

These Terms and Conditions and all documents to which express references are made constitute the entire agreement between us and the User, regarding the object of the contract, and replace any other pact, agreement or promise previously established between Fiappo and the User, orally or in writing.

Fiappo and the User acknowledge that they have consented to the conclusion of the contract without having relied on any declaration or promise made by the other party or that may interfere with any written declaration in the negotiations carried out by both parties before this contract, unless what is expressly mentioned in these Terms and Conditions.
